| A D Computer automatically handles filing new hires for all states for companies with a location in Pennsylvania and/or New Jersey. For clients without a location in Pennsylvania and/or New Jersey, A D provides a new hire report to be sent to the appropriate agency. | |||||||
| Under the Personal Responsibility and Work Opportunity Act of 1996 (Pub. L. No. 104-193), all employers are required to report certain information concerning their newly hired employees to a State Directory of New Hires. | |||||||
| All employers are required to furnish a report for each newly hired employee which includes the name, address and social security number of the employee, and the name, address and Federal Employer Identification Number of the employer. The report must be sent to the State Directory of New Hires in the state in which the newly hired employee works. Multistate employers have the option of transmitting all new hire reports electronically or magnetically to one state provided that the employer notifies the Secretary of the Department of Health and Human Services. | |||||||
| Under federal law, each state may provide the time within which employers must submit their new hire reports to the State Directory of New Hires, but such reports must not be made later than 20 days after the date the employer hires the employee. Because federal law allows each state to set the reporting period for employers, subject to federal statutory limits, states have the flexibility to impose requirements more stringent than the 20-day reporting requirement. However, employers who are magnetic or electronic filers are allowed to submit their new hire reports twice each month, not less than 12 nor more than 16 days apart. | |||||||
